Your notice MUST include all of the following (per 17 U.S.C. § 512(c)(3)): (1) A physical or electronic signature of the copyright owner or a person authorized to act on their behalf. (2) Identification of the copyrighted work claimed to have been infringed (or, for multiple works on a single site, a representative list). (6) A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. Send the completed notice to [email protected], or by mail to the Designated Agent address above. Notices that do not substantially meet all six requirements above may not be actionable.

4. What Happens After We Receive a Valid Notice

Upon receipt of a notice that substantially complies with the DMCA, BlastMeet will: • Promptly remove or disable access to the allegedly infringing material; • Notify the user who posted the material that it has been removed and provide them with a copy of the notice (with personal contact details redacted on request); • Inform the user of the counter-notification procedure described in Section 5; and • Apply the action toward our Repeat Infringer Policy described in Section 7.

5. Filing a Counter-Notification

If you are a BlastMeet user whose content has been removed under this policy and you believe the removal was the result of mistake or misidentification, you may submit a counter-notification to our Designated Agent. Per 17 U.S.C. § 512(g)(3), your counter-notification MUST include: (1) Your physical or electronic signature. (2) Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed. (3) A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material. (4) Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, the U.S. Federal District Court for the District of Delaware), and that you will accept service of process from the person who filed the original notification. Upon receipt of a valid counter-notification, we will forward it to the original complainant and may restore the removed material in 10 to 14 business days unless the complainant notifies us that they have filed a court action seeking a restraining order against you.

6. Penalty for Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, OR that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees, incurred by the alleged infringer, the copyright owner, the copyright owner's authorized licensee, or BlastMeet. Do not submit false claims. Do not submit a takedown notice for material you do not own or are not authorized to act on behalf of.

7. Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i)(1)(A), BlastMeet has adopted and implemented a policy providing for the termination, in appropriate circumstances, of accounts of users who are repeat copyright infringers. Specifically: • Each valid DMCA takedown notice that results in the removal of content from a user's account is recorded as a "strike" against that account. • A counter-notification that results in the restoration of the content (per Section 5) reverses the corresponding strike. • An account that accumulates three (3) unresolved strikes within any 12-month period will be terminated, and the user will be permanently banned from creating a new BlastMeet account. • In cases of egregious or willful infringement, BlastMeet reserves the right to terminate an account immediately upon a single valid notice, without warning.

8. Trademark, Right of Publicity, and Other Claims

This DMCA Policy applies only to copyright claims under U.S. law. For trademark infringement, right-of-publicity violations, defamation, impersonation, or other intellectual-property concerns, please contact [email protected] with a description of the issue and the location of the offending material. We review such requests on a case-by-case basis.

9. Changes to This Policy

We may update this DMCA Policy from time to time. When we do, we will update the effective date at the top of this page. The current Designated Agent registration on file with the U.S. Copyright Office controls in the event of any conflict with this page.
